Terms of Service

These Terms of Service ("Terms") are an agreement between AthEngine LLC, a Florida limited liability company ("athengine," "we," "us" or "our") and each person or club that uses athengine.

By creating an account, registering a player or otherwise using athengine, you agree to these Terms. If you use athengine for a club, you accept them for that club and confirm you have the authority to do so. Our Privacy Policy explains how we handle information. If a club has a separate written agreement with us, that agreement wins where the two conflict.

1. The service

athengine is software baseball clubs use to run registrations, tryouts, payments, rosters, schedules, player metrics and evaluations, recruiting profiles and a public club website. Each club runs its own program. We provide the tools. We are not part of any club, and we do not decide tryouts, team placement, playing time, evaluations or recruiting outcomes.

2. Accounts

• Give accurate information and keep it current.
• Keep your sign-in secure. You are responsible for activity under your account.
• A family account must be held by a parent or legal guardian who is at least 18.
• A player may use a sign-in only with the permission of a parent or guardian and the club.
• Tell us right away if you think someone has used your account without permission.

3. Club responsibilities

A club that uses athengine is responsible for:

• the information it collects, enters or uploads, and having the right to use it;
• getting any consent the law requires, including a parent or guardian's consent for information about a minor, before it is entered or shared;
• its own notices, policies, waivers and refund rules for families;
• deciding which staff get access, and removing access when someone leaves;
• what it publishes on its club site and in announcements; and
• following the laws that apply to its program.

4. Families

When you register a player, you confirm you are that player's parent or legal guardian, or are allowed to act for them, and that the information you give is accurate. Your agreement with the club, including its waivers and policies, is between you and the club.

5. Payments and refunds

• Each club sets its own prices for tryouts, seasons, gear and other fees.
• Payments are processed by Stripe. Card details go to Stripe, not to athengine.
• From each payment, athengine keeps an amount that covers card processing costs, plus a platform fee on each season registration. The rest is paid out to the club's own Stripe account. These amounts come out of the price the family sees at checkout, not on top of it. Clubs can see them in their pricing and financial screens.
• If a family picks a payment plan, the card saved with Stripe is charged automatically on the schedule shown when the plan is chosen.
• A club can also accept payment outside athengine. Those arrangements are between the family and the club.
• Refunds follow the club's refund policy. The club issues a refund through athengine, and it goes back to the original payment method. athengine's fees are not refunded.
• A club can close a season, and a closed season no longer takes payments.
• Questions about a charge go to the club first.

6. Acceptable use

You may not:

• use athengine for anything unlawful, harmful, deceptive or harassing;
• upload content you do not have the right to share, or that exposes a minor in a way their parent or guardian has not allowed;
• access another club's or family's information without permission;
• interfere with or try to break the security of the service;
• scrape, copy or resell the service, or reverse engineer it except where the law allows; or
• upload malicious code.

7. Your content

You and your club own the content you put into athengine. You give us permission to host, process, display and send that content as needed to run the service, including showing it on the club's public site under the club's and family's settings. We own athengine itself, including the software and design. If you send us feedback, we may use it without owing you anything.

8. AI features

Some features use AI to draft text. Drafts can be wrong. Review them before you rely on or share them. AI output is not a professional scouting report or a promise about recruiting.

9. Third-party services

athengine relies on other companies, including Stripe for payments and Google for optional sign-in. Their own terms apply to your use of their services, and we are not responsible for them.

10. Changes, suspension and termination

We may change, add or remove features. You can stop using athengine at any time. We may suspend or close an account that breaks these Terms, puts others at risk or is required by law. When a club leaves, we will work with it on its data as the Privacy Policy describes. Sections that should last after termination, such as ownership, disclaimers, limits of liability, indemnity and governing law, continue to apply.

11. Disclaimers

To the fullest extent the law allows, athengine is provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the service will be uninterrupted or error-free. We are not responsible for a club's programs, events, facilities, staff or decisions.

12. Limitation of liability

To the fullest extent the law allows, athengine will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims about the service is limited to the greater of what you paid athengine in the 12 months before the claim, or $100. Amounts a family pays a club are not payments to athengine.

13. Indemnity

A club will defend and hold athengine harmless from claims arising from its program, its content, the information it collects, or its breach of these Terms or the law.

14. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Disputes will be heard in the state or federal courts located in Florida.

15. Changes to these Terms

We may update these Terms. If a change is significant, we will update the effective date and let clubs know. Using athengine after an update means you accept the new Terms.
